1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Roof Expert USA (“Company,” “we,” “our,” or “us”) governing your access to and use of https://clevelandoh.roofexpertusa.com/ and our telephone referral dispatch services.

By accessing our Site or calling our dispatch phone number (888) 208-4155, you acknowledge that you have read, understood, and agreed to be bound by these Terms in full. If you do not agree with any part of these Terms, you must immediately discontinue use of our Site and services.

2. Description of Referral Dispatch Service

Roof Expert USA operates exclusively as an emergency intake and contractor referral dispatch service. We connect property owners experiencing acute roofing emergencies with third-party, independent roofing contractors who operate within Cuyahoga, Lake, Geauga, and Lorain counties.

Roof Expert USA is NOT a licensed roofing contractor, construction firm, or engineering consultant. We do not hold construction licenses, perform physical labor, climb roofs, execute steam ice dam removals, or warrant physical construction craftsmanship. Dispatched service providers are completely autonomous, independent contractors who determine their own operational procedures, safety practices, pricing structures, and contractual guarantees.

3. Independent Contractor Relationship & Scope of Work

When you request emergency dispatch through our telephone center, our role is strictly limited to relaying your inquiry and property details to an available independent contractor. The formal contractual relationship for physical inspection, emergency steam mitigation, temporary timber tarping, and permanent roof restoration exists solely between you and the dispatched independent contractor.

Users are advised to independently verify that the assigned contractor possesses current municipal contractor registration with the City of Cleveland Department of Building and Housing or applicable suburban building departments, active general liability insurance, and valid Ohio Bureau of Workers' Compensation coverage before allowing work to commence.

4. Disclaimer of Warranties

THE SITE AND DISPATCH SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, ROOF EXPERT USA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that emergency contractor dispatch will be instantaneous, that dispatched contractors will accept every project, or that work executed by third-party contractors will prevent all future water penetration. All warranties regarding materials and physical labor must be obtained directly in writing from the independent contractor performing the work.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY OHIO LAW, IN NO EVENT SHALL ROOF EXPERT USA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to use our Site or telephone dispatch line;
• Any delay, failure, or refusal of an independent contractor to mobilize to your location;
• Any acts, omissions, errors, or negligence of independent third-party contractors;
• Property damage, water intrusion, electrical damage, mold infestation, structural collapse, or personal injury occurring on your premises.

Our total aggregate liability for any and all claims arising under these Terms shall not exceed the amount of fifty U.S. dollars (.00).

6. Governing Law & Jurisdiction

These Terms and any dispute arising from your use of the Site or dispatch services shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action or proceeding related to these Terms shall be instituted exclusively in the state or federal courts located within Cuyahoga County, Ohio.
